Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Edureserve ("we," "our," or "us") regarding your use of the HabitStreak application (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not access or use our Service. These Terms apply to all users of the Service, including parents and children using family accounts.

Service Description

HabitStreak is a family-oriented habit tracking application that enables:

• Parents to create and manage family accounts
• Setting up and monitoring children's daily habits
• Tracking progress and maintaining habit streaks
• Managing rewards and incentive systems
• Communication between family members within the app

The Service is designed to be educational and supportive, helping families develop positive habits together.

User Eligibility and Account Requirements

General Requirements

• You must be at least 18 years old to create a parent account
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You may only create one account per email address

Children's Accounts

• Children under 13 require parental consent to use the Service
• Parents are fully responsible for their children's use of the Service
• Children's accounts are managed and monitored by their parent account
• Parents can access, modify, or delete their children's data at any time

User Responsibilities

All Users Must:

• Use the Service in compliance with all applicable laws and regulations
• Respect the privacy and rights of other users
• Provide accurate information when using the Service

Parents Additionally Must:

• Supervise their children's use of the Service

Prohibited Activities

You may not use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Share inappropriate, harmful, or offensive content
• Attempt to gain unauthorized access to the Service or other user accounts
• Interfere with the Service's operation or infrastructure
• Share account credentials with unauthorized persons
• Create fake accounts or impersonate others
• Collect or harvest personal information from other users
• Use automated systems to access the Service without permission
• Reverse engineer or attempt to extract source code
• Use the Service for commercial purposes without authorization

Intellectual Property Rights

Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

• Create and manage habit data within your family account
• Share progress information within your family circle

User Content

You retain ownership of content you create through the Service (such as habit names, notes, and family communications). By using the Service, you grant us a license to store, process, and display this content as necessary to provide the Service.

Subscription and Payment Terms

Free Trial

We offer a free trial period for new users. Trial terms, including duration and included features, are specified during signup and may vary by region and platform.

Paid Subscriptions

• Subscription fees are charged in advance for the selected billing period
• Prices are displayed in your local currency and include applicable taxes
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage subscriptions through your device's app store or our website

Refunds

Refund policies are governed by the platform through which you purchased your subscription:

• iOS App Store: Refunds are handled according to Apple's refund policy
• Direct purchases: Contact us within 30 days for refund consideration
• Promotional subscriptions: May have different refund terms as specified

Educational Purpose

HabitStreak is designed for educational and motivational purposes. It is not intended to replace professional advice regarding child development, psychology, or health matters. Parents should use their judgment and consult professionals when needed.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDURESERVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold Edureserve harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights. This includes defending against claims related to content you create or actions taken through your account.

Class Action Waiver

Where permitted by law, you agree to resolve disputes individually and waive the right to participate in class action lawsuits or collective proceedings.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify you of significant changes by:
